Facebook Terms and Conditions for ‘Valentine’s Meal Selector’

 

1. Promoter
The promoter of the Promotion is Waitrose Ltd, Southern Industrial Area, Bracknell, Berkshire
RG12 8YA (the “Promoter”).

 

2. Promotion Period
The Promotion will be open for entries from Monday 11th February 2013 at 14.00 GMT and will close on Thursday 14th May 2013 at 23.59 GMT.  

 

3. Eligibility
All residents of the United Kingdom (excluding the Channel Islands) who are 18 years of age or older at the time of entry, and have a valid Facebook account, which is not a ghost account (as defined below), are eligible to enter.  Employees (and their families) of the Promoter, affiliates, subsidiary companies, representatives or agents of those companies and anyone else who has been professionally involved with the Promotion are not eligible to enter.

 

4. Method of entry
Entries must be via Facebook.com/waitrose and entry into the draw implies acceptance of these conditions. Entrants are entered into the Promotion automatically when using the ‘Valentine’s Meal Selector’ app, located on a tab on the Promoter’s Facebook page. Entrants must accept and allow the necessary Facebook permissions for their entry to be considered valid.

All entries must be received by 23.59 GMT on Thursday 14th February 2013 to be considered as a valid entry into the competition. No responsibility will be accepted for any entries that are illegible, incomplete, lost or delayed in transit or which fail to be properly submitted. Proof of sending will not be accepted as proof of receipt. The promoter and their agents accept no responsibility for difficulties experienced in submitting an entry to this promotion.

 

5. Criteria for determining winner
The prize will be awarded to the first entry selected at random on Tuesday 19th February 2013 from all the valid entries received by the closing date. Entries received after the closing date cannot be considered.

Waitrose and partners are responsible for the promotion, which is the publication and adjudication of the prize.

6. Prize

The prize consists of two Waitrose Cookery School vouchers for a course of the winner’s choice.

The Promoter will reimburse travel expenses of up to £100 each for the winner and their guest. Full receipts must be provided to be eligible for this reimbursement.  

The prize is as stated, is non-transferable and no cash alternative is available.  The Promoter reserves the right to award an alternative prize of equal or greater value, should the advertised prize or any part of it become unavailable for any reason.

7. Notification to winners
Winners will be notified by email by Wednesday 27 February 2013 by the Promoter or a representative of the Promoter from our technical partner Manning Gottlieb OMD.

All reasonable effort will be made to contact the winners; however, if the promoter is unable to contact a winner within 7 days of the draw, the promoter reserves the right to redraw and select another winner from the entries already received subject to the same terms and conditions specified herein.

If the winner of the draw is unable to take up the prize for any reason, the promoter reserves the right to award it to an alternative winner, in which case the first winner chosen will not be eligible for any share of the prize whatsoever.

If events occur that render the promotion or the awarding of the prizes impossible due to reasons beyond Waitrose’s reasonable control, it may, at its discretion, vary or amend the promotion accordingly and the promoter reserves the right to provide an alternative prize of equal or greater value in such circumstances.

The promoter reserves the right to withdraw or amend this promotion in the event of any unforeseen circumstances outside their reasonable control.

The promoter reserves the right to terminate or temporarily suspend this promotion in the event of technical or other difficulties that might compromise its integrity.

8. Exclusion from participation
This promotion is limited to one entry per person. (i.e. One entry per valid email address). Multiple entries from the same person or email address will not be entered into the competition.

Use by any participant of any unauthorised codes, hacking or interference with the Promotion will invalidate entries.

Creation of “ghost accounts” (accounts created in order to vote) will invalidate any entries submitted. Participants with less than 10 Facebook friends will be deemed to be ghost accounts and their entries will be removed from the Promotion.


9. Use of Personal Data
The Promoter will never release your personal details to any company outside of the John Lewis Partnership (which includes John Lewis, Waitrose, Greenbee, John Lewis Insurance and John Lewis Financial Services Ltd) other than Manning Gottlieb OMD, who for the purposes of this competition will be be responsible for assisting with the promotion of the prize and arranging delivery of prize. By participating in the prize draw you agree that the Promoter and any other company within the John Lewis Partnership may use and store your personal details in England, Scotland, Wales, Guernsey or Jersey in the course of running the competition, as set out in these terms and conditions, for related purposes such as promoting the competition and announcing and publicising the winner and advertising products offered for sale by the John Lewis Partnership, subject to compliance with applicable data protection laws.

Participants’ names and e-mail addresses (together, “Personal Data”) will be collected, processed and stored in the course of the Promotion.  After completion of the Promotion, all Personal Data will be deleted without delay.

No other transfer of Personal Data to third parties or other use of Personal Data will take place.

 

10. Limitation of liability
The Promoter makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with the Promotion.

The Promoter shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit the Promoter’s liability for death, personal injury or fraud.

The Promoter will not be responsible for any third party's performance or failure to perform any services related to the Promotion, nor for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion, provided that nothing shall limit the Promoter’s liability for death or personal injury caused by its negligence.

Proof of submitting your entry is not proof of receipt of an entry by the Promoter.  The Promoter is not responsible for any entries that fail to be submitted for any technical reason whatsoever.  

Although the Promoter will use reasonable efforts to ensure that all information relating to the Promotion ("Promotion Material") is accurate, the Promoter is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect the Promoter’s operation of the Promotion or the site, including without limitation the accuracy of any Promotion Material.

11. General
If events occur that render the promotion or the awarding of the prizes impossible due to reasons beyond Waitrose’s reasonable control, it may, at its discretion, vary or amend the promotion accordingly and the promoter reserves the right to provide an alternative prize of equal or greater value in such circumstances.

The promoter reserves the right to withdraw or amend this promotion in the event of any unforeseen circumstances outside their reasonable control.

The promoter reserves the right to terminate or temporarily suspend this promotion in the event of technical or other difficulties that might compromise its integrity.

The decision of the Promoter regarding any aspect of this Promotion is final and no correspondence will be entered into.

Terms and Conditions are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these terms and conditions.

The Promotion is not associated with Facebook and is in no way sponsored, endorsed or organised by Facebook.  The recipient of the provided information is not Facebook, but the Promoter.

Entrants are deemed to have accepted these terms and conditions by participating in this promotion.
