WHO CAN ENTER
This competition is open, subject to any other qualifications in these terms and conditions, to all residents of the United Kingdom (excluding Northern Ireland) who are aged 21 years or over with a valid email address, except for employees of the Promoter, its associated companies, agents, third parties or anyone else professionally connected with this competition. Proof of age may be required.
By submitting a competition entry, you are agreeing to be bound by these terms and conditions. The instructions provided at the point of entry form part of the terms and conditions of this competition. In the event of a conflict, these terms and conditions take precedence.
Purchase of any pack of Brooklyn Pilsner, subject to availability online and/or in store, from Waitrose is necessary. You will need your receipt number to enter. Retain proof of purchase until at least 1st January 2023. There is no additional charge to submit an entry via the website at waitrose.com/winwithbrooklyn.
DEADLINE FOR ENTRIES
Entries must be received between 00:01 on 2nd November 2022 and 23:59 on 29th November 2022 (the “Closing Date”). Entries received after the Closing Date will not be accepted.
HOW TO ENTER
To enter, simply go to waitrose.com/winwithbrooklyn, follow the competition instructions at the top of the page and submit your details and other required information using the online form provided.
There is a limit of one entry per person. Multiple entries submitted directly or with the use of any automated systems will not be entered into the draw.
No responsibility will be accepted for entries that are lost, delayed, mislaid or damaged in transit, regardless of the cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware or software failure of any kind.
Those entries not in accordance with the rules will be void and will entitle the Promoter to exclude the entry from the competition; any entry containing false, incomplete or misleading information will be void and will entitle the Promoter to exclude the entry from the competition.
THE PRIZE
The prize is a three-night holiday for the winner and one guest to Brooklyn, New York City, United States of America. There is 1 prize package available to be won. This package will include:
pre-booked flights from a major UK airport to a major New York/New Jersey area airport (exact route depending on departure location) in standard / economy class with hand luggage only. Return flight included. There is no flight alternative;
airport transfer from New York/New Jersey airport to the apartment and return transfer from the apartment to New York/New Jersey airport;
accommodation at a three-star hotel for 3 nights with the winner and their guest sharing a double / twin bedroom or equivalent being provided;
a food / drinks allowance for two up to the value of £200 (Allowance) to be spent during the holiday (see paragraph 4.5 regarding the payment of the Allowance); and
1 pair of tickets for a tour of the Brooklyn Brewery at 79 N 11th St., Brooklyn, New York to be used during the 3-night holiday on the date notified to the winner (Brewery Tour Tickets) including transfers to and from the apartment, subject to the following:
Use of the Brewery Tour Tickets and entry into the applicable venue is subject to the venue regulations in force at that venue from time to time. Entry into the venue is also subject to the terms and conditions on the Brewery Tour Tickets. The Brewery Tour Tickets must be used by the winner and their guest at the venue and on the time and date shown on the Brewery Tour Tickets during the opening hours of that venue. Brewery Tour Tickets will be emailed to the winner using the email address provided by the winner.
The prize is being provided by Carlsberg Marston’s Brewing Company Limited (company number 00078439), whose registered office is at Marston’s House, Brewery Road, Wolverhampton, WV1 4JT (Carlsberg Marston’s).
The prize will be booked by XSEM Limited (company number 04654429), whose registered office is at Leigh House, St. Pauls Street, Leeds, LS1 2JT (XSEM), and the winner will provide all reasonable assistance to XSEM for such purposes. A valid credit or debit card may be required for security deposit purposes when checking into accommodation.
Any travel expenses, or any other expenses in the general use of and enjoyment of the prize, that the winners or their guests incur outside of those indicated in the prize package details are the sole responsibility of the winners or their guests.
XSEM, on behalf of the Promoter, will transfer to a bank account nominated in writing by the winner, the amount of the Allowance (£200) prior to the date booked for travel. For the avoidance of doubt, any overspend above the Allowance shall be the sole responsibility of the winner and / or their guest. The Promoter and XSEM will not be liable to pay any further sums in excess of the Allowance which have arisen as a result of any associated travel delays or cancellations.
XSEM will provide details of the available accommodation options and further prize details when the winner is contacted. Once the winner has accepted the prize in accordance with section 6.1. the winner must promptly confirm to XSEM their preferred accommodation choice and travel dates within 14 days of being contacted. Accommodation choices are subject to booking availability and service is at the relevant manager’s discretion. The winner understands that their first accommodation choice and travel dates may not be available.
The winner and their guest must provide their own travel insurance and any necessary vaccinations, immunisations or similar and supply proof of insurance to XSEM upon request. Both the winner and their guest must be legally able to travel to New York in the United States of America on the date booked for travel (including, but not limited to, meeting any Covid-19 regulations / restrictions which apply), attend the brewery tour and obtain all necessary visas and other documentation (including, but not limited to, Covid-19 documentation required). Copies of valid passports will also be required.
Prizes must be claimed within twelve months of the winner being notified by XSEM
Prizes are subject to availability. They are non-transferable, non-refundable and, unless stated, there are no cash alternatives. In the event that the prize is out of availability or if circumstances beyond the Promoter’s control make it necessary to do so, the Promoter reserves the right to substitute another item, in its sole discretion, of equal or higher value.
WINNER SELECTION
All valid and, if applicable, correct entries received by the Closing Date will be entered into a prize draw, and the winner will be picked at random.
The winner’s details (surname and county only) will be available for one month after the Closing Date by sending a request to the Promoter by at Waitrose Limited, Media Team, Floor 2, Waite House, Doncastle Road, Southern Industrial Area, Bracknell RG12 8YA, enclosing a stamped self-addressed envelope, or alternatively by emailing customerserviceteam@waitrose.co.uk.
The winner and their guest must provide a copy of their identification to prove they are 21 years old or over before the prize is awarded. If that identification shows that the winner is under 21 years old or if the winner does not provide valid identification within 14 days of notification that they have won, the prize will be forfeited and a replacement winner may be drawn at the Promoter’s sole discretion. If identification provided by the winner’s guest shows that such guest is under 21 years old or if a guest of a winner does not provide valid identification within 14 days of notification to the winner that they have won, the winner will be contacted and will be asked to select an alternative / replacement guest. These terms and conditions will apply to any alternative / replacement guest(s) selected. A failure to respond to requests in respect of guest’s identification and / or selecting an alternative / replacement guest (if applicable) or a failure of any guest to provide valid identification showing that they are 21 years old or over within the specified timeframes may result in the prize being forfeited and a replacement winner being drawn at the Promoter’s sole discretion.
WINNER NOTIFICATION
Winners will be notified by email, text or phone call as soon as practicable after the prize draw, using the contact details provided with the competition entry. The winner will be required to respond within 30 days of notification (unless otherwise stated) confirming their acceptance of the prize. In the event the winner does not respond to communications within this period or if any prize is declined, the Promoter reserves the right to disqualify that winner and draw another winner.
Please allow 60 days from the date of the winner’s address verification for delivery of the prize.

Carlsberg Marston’s will not process or receive any of your personal data which is received in connection with this promotion.
LIMITATION OF LIABILITY
The Promoter and its associated agencies, companies and distributors will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using the prize, except for any liability which cannot be excluded by law (including liability for fraud or death or personal injury arising from negligence) in which case that liability is limited to the minimum allowable by law. Your statutory rights are not affected.
If you have opted-in to receive further information or marketing from any of the Promoter’s agents or suppliers involved in the administration of this competition, you understand and accept that the relevant third party will be solely responsible for any processing of your personal data for these purposes, that such processing will be governed by terms of that third party’s privacy policy and that the Promoter accepts no responsibility or liability in association with any such data processing for these purposes.
GENERAL
If there is any reason to believe that there has been a breach of these terms and conditions or if the Promoter believes that your conduct may be unlawful or otherwise bring the competition into disrepute, the Promoter may, at its sole discretion, reserve the right to make your entry void and will entitle the Promoter to exclude you from participating in the competition.
The decision of the Promoter regarding any aspect of the competition is final and binding and no correspondence will be entered into.
The Promoter reserves the right to suspend, cancel, or amend the prize competition where it becomes necessary to do so, with no liability to any entrants or third parties.
This competition and all issues arising out of it shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the English courts.
