Terms and Conditions of Use: Waitrose Limited Food and Drink Virtual Festival
These terms and conditions (the Terms) set out the basis on which Waitrose Limited will provide services to you and anyone you purchase a Waitrose Limited Food and Drink Virtual Festival ticket for. For the purposes of these Terms, “Waitrose”, “we”, “us” and “our” refer to Waitrose Limited, a company registered in England and Wales with company number 99405, VAT number 232457280 and registered address 171 Victoria Street, London, SW1E 5NN.
These Terms apply to your use of the Waitrose Limited Food and Drink Virtual Festival Service. The Waitrose Limited Food and Drink Virtual Festival Service means all services provided by Waitrose to you for the purposes of hosting and providing webinars on a variety of subjects relating to food and drink via digital conferencing facilities.
As set out in more detail in the relevant sections of these Terms, we have engaged third parties to provide some of the services related to the Waitrose Limited Food and Drink Virtual Festival as follows. The online booking and payment services will be provided by Kick Digital Limited, a company registered in England and Wales with company number 08967728 with registered office at Unit 2 Endeavour House Parkway Court, Longbridge Road, Marsh Mills, Plymouth, Devon, PL6 8LR. Online booking and payment services means all services for the purposes of registering, booking and paying for a ticket. The digital services will be provided by Star Group Live a company registered in England and Wales with company number 11098773 with registered office at Star Live Milton Road, Thurleigh, Bedford, MK44 2DF. Digital services means all services for the purposes of providing digital conferencing facilities to host and access the events digitally. By using the services of these third parties, you agree to and accept the provisions of any of each third party's applicable terms and conditions and/or privacy policy, as notified by them to you as part of using their services.
By purchasing a ticket or otherwise using the Waitrose Limited Food and Drink Virtual Festival Service, you confirm that you accept these Terms of use and that you agree to comply with them. You also confirm this for anyone you purchase a ticket for. If you do not agree to these terms, please do not use the Waitrose Limited Food and Drink Virtual Festival Service.
We may amend these Terms from time to time. Every time you wish to use the Waitrose Limited Food and Drink Virtual Festival Service, please check these Terms to ensure you understand the terms that apply at that time. Your continued use of the service following such change shall be deemed to be your acceptance of such change.
Virtual events
Waitrose has taken every care in the preparation of the Waitrose Limited Food and Drink Virtual Festival Service and will provide the classes and events with reasonable care and skill. However, to the extent permitted by applicable law, Waitrose does not represent or warrant the accuracy or reliability of any of the information or content about any goods or services, software or advertisements which are provided or distributed through, or linked, downloaded or otherwise accessed by way of the Waitrose Limited Food and Drink Virtual Festival Service. No warranty is given that the Waitrose Limited Food and Drink Virtual Festival events or associated services shall be available on an uninterrupted basis.
You must be at least 16 years old to purchase a Waitrose Limited Food and Drink Virtual Festival ticket, or 18 years old to purchase a ticket and participate in a Waitrose Limited Food and Drink Virtual Festival event which has alcohol as a subject matter. Children may attend events which are unrelated to alcohol on the additional terms relating to children attendees as set out below. By purchasing a ticket, you warrant that at the time of the event you will be at least 16 years old or over, or, in the case of events relating to alcohol, 18 years old or over.
Access to the Waitrose Limited Food and Drink Virtual Festival events will be facilitated by Star Group Live, a company registered in England and Wales with company number 11098773 with registered office at Star Live Milton Road, Thurleigh, Bedford, MK44 2DF. The digital link and platform used for us to host and for you to access and attend the virtual events will be provided by Star Group Live by email. Your first name, last name, email address and any other personal data collected for the purposes of allowing Star Group Live to perform their services will be obtained and processed by Star Group Live in accordance with our instructions and in compliance with any applicable data protection legislation.
The Waitrose Limited Food and Drink Virtual Festival will consist of virtual events, which will be presented by way of a webinar. This means that there will be no video or microphone function available to attendees but attendees will be able to see and hear the host presenting the virtual event. The only way an attendee can contribute to the virtual event is by using the 'chat' function by typing out a message. Any message sent on the 'chat' function will be seen by all attendees.
Tickets will be allocated on a first-come-first-served basis and are subject to availability. The ticket that you purchase can only be used for the particular day you have chosen to buy a ticket for. This ticket allows you to attend as many events as you would like within that day. For example, if you purchase a ticket for only one day of the Waitrose Limited Food and Drink Virtual Festival, you can attend all or as many events within the day that your ticket corresponds to. If you wish to attend the events run in the other days of the Waitrose Limited Food and Drink Virtual Festival, you will have to purchase a new ticket for each of those days.
Booking and payment
Payment must be made in full at the time of booking and all amounts quoted are inclusive of VAT. You are responsible for ensuring that all details you submit via any booking and payment process are correct and up to date. The booking and payment process for purchasing a ticket is facilitated by Kick Digital Limited, a company registered in England and Wales with company number 08967728 with registered office at Unit 2 Endeavour House Parkway Court, Longbridge Road, Marsh Mills, Plymouth, Devon, PL6 8LR. Any personal data collected through the booking process will be processed by Kick Digital Limited in accordance with our instructions and in compliance with any applicable data protection legislation.
Cancellations, changes and refunds
We reserve the right to cancel an event, with reasonable notice and will notify you in writing, should this happen. You will be given a full refund of ticket prices should the event be cancelled by Waitrose.
We reserve the right to change the date of any event for any reason, although such rearrangement is not guaranteed. If we do so, we will endeavour to give you reasonable notice, and, where you cannot attend the event on the new date, you will receive a full refund of the amount paid for that event.
We will endeavour to run the event as advertised. However, we reserve the right to make changes, including to the running order and timings for the event may change prior to the event. Where reasonably possible, we will provide prior notice of such changes.
If you cancel your booking with prior notice of more than 5 working days from the festival date, you will be refunded the fee paid. If you cancel with prior notice of 4 of working days or less, the festival will be charged to you at the full fee.
Conduct
We will not tolerate any behaviour or conduct which, in our reasonable opinion, poses a danger or causes or is likely to cause nuisance, annoyance, offence or distress to any participant of a Waitrose Limited Food and Drink Virtual Festival event, and we may terminate a class immediately if any participant displays conduct of this kind. We reserve the right to blacklist you from our services and/or take any appropriate legal action, in the event that a legitimate complaint is made about your conduct during a Waitrose Limited Food and Drink Virtual Festival event.
Privacy & Security
When you sign up for any virtual events or otherwise use the Waitrose Limited Food and Drink Virtual Festival Service, any personal data you may submit through the booking process which may be subsequently shared with us, will be processed in accordance with our Privacy Policy, which can be found here https://www.waitrose.com/ecom/help-information/privacy-notice. When you use the Waitrose Limited Food and Drink Virtual Festival Service, John Lewis Plc is the data controller of your personal data.
The personal data we collect about you may include your name, date of birth or age, email, address, telephone number, debit/credit card details and marketing preferences.

We will not retain your personal data for longer than necessary to provide you with the services that you have requested, or if longer, the period of time required by applicable laws and regulations.
The virtual events will be recorded for safety and security purposes. The recordings will capture only the images and sounds of the Waitrose or the supplier representative presenting at the event. Therefore, the recordings will not capture any images or sounds of the attendees, only of the representative. Waitrose will store the recordings until 15th November 2021. These recordings will also be held by Star Group Live and shared to the suppliers of the food and drink presented throughout the Waitrose Limited Food and Drink Virtual Festival. By joining a session, you agree to such recordings.

Except as expressly provided in these Terms, we exclude all representations, conditions and warranties whether express or implied (by statute or otherwise) to the fullest extent permitted by law. We do not seek to exclude or limit our liability to you where it would be unlawful to do so.
Please note that the Waitrose Limited Food and Drink Virtual Festival Service is provided for domestic and private use only. You therefore agree not to use the Waitrose Limited Food and Drink Virtual Festival Service for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Terms and Conditions for Specific Waitrose Limited Food and Drink Virtual Festival Classes: Food
In addition to the Terms detailed above, the following additional terms and conditions shall apply in respect of any Waitrose Limited Food and Drink Virtual Festival classes and associated services for education related to food or cookery.
You acknowledge that it is your responsibility to be aware of any food allergies or dietary requirements, and any food allergies or dietary requirements of any individuals you book a class for.
When undertaking any cooking as part of a Waitrose Limited Food and Drink Virtual Festival food/cooking class, you acknowledge that it is your responsibility to adhere to a reasonable standard of health and safety and to maintain a reasonable standard of safe behaviour and food hygiene. In particular, you should be aware of additional safety measures which should be in place when using any sharp or hot implements and you should give these the appropriate level of attention and care when using them. You should not carry out any activity which you are not capable of carrying out safely. You should follow directions as given by the host of the Waitrose Limited Food and Drink Virtual Festival class, and you acknowledge that it is your responsibility to ensure that that all food is cooked properly before being consumed.
Terms and Conditions for Specific Waitrose Limited Food and Drink Virtual Festival Classes: Alcohol
In addition to the Terms detailed above, the following additional terms and conditions shall apply in respect of any Waitrose Limited Food and Drink Virtual Festival classes and associated services for education related to alcohol.
By using the Waitrose Limited Food and Drink Virtual Festival Service for classes or events relating to alcohol, you agree that you and any participants for who you book a class are legally old enough to drink alcohol and will consume any alcohol responsibly.
Terms and Conditions Relating to Children
Children must not attend any Waitrose Limited Food and Drink Virtual Festival classes which relate to the subject matter of alcohol. As noted above, by attending a class or event related to alcohol, you confirm that, at the time of the class, you will be 18 years old or over.
Every child attending a Waitrose Limited Food and Drink Virtual Festival class or event must be accompanied by a parent/guardian over the age of 18. The accompanying adult will be solely responsible for any child or children attending a Waitrose Limited Food and Drink Virtual Festival class or event.
